It has come up a lot, and its been debated to death.
It's a real shame that there is so little that can be done about it, believe you can report them to e bay for breaching rules but even then it doesn't guarentee removal.
Some people say it helps build awarness of emulation and such but its at detrement to those creating the layouts.
Its a problem that will never go away sadly

If the emu creators and layout designers that dont want their work sold on ebay go to ebay and register with the VERO program (free of charge, look under the site map for it)
then they will be in ebays eyes the only person allowed to sell that item.
Once registered, just fax of a form to ebay for each listing that contains the said layout or emulator, and ebay will pull the auction no questions asked.
The person selling the item will get their knuckles wrapped by ebay, and if they continue to do so, they will lose their account. Vero works, but you
have to register with it and report the auctions.
Problem is most auctions dont specify exactly what is on the cd, and in that instance ebay is reluctant do anything if you cant prove your item is for sale.

eBay will do bugger all within 24 hours, trust me... and normally they take 48 hours.
