1) There is no public existing emulator for a lot of the newer games. MPU6 and Scorpion 5 aren't emulated publicly at all. MPU5 and Scorpion 4 are emulated for the main board, but there are some extra bits used by the newer games which aren't emulated enough to make the games run.
2) Assuming we had the necessary emulators, there is no hard and fast rule as such. The only semi official rule we ever had was from empire games which requested that no machine newer than 3 years old was made into a layout. And when that rule got broken by the forums several times, they (Empire) then requested that we removed all empire intellectual property (ROMs/Artwork) from the forums.
As for all the other manufacturers I believe we have never had any rules at all. Though I would imagine if layouts started appearing for latest DOND games and such they would probably have something to say.
Emulation legality is a bit of a grey area but for the most part as long as we steer clear of the newest games we aren't doing enough harm to warrant an expensive lawsuit. And I'm sure in some ways the emulator generates more customers for them.
If they really wanted to any manufacturer could stop us sharing the artwork and roms, but the emulators are there for nostalgia, and I know of a few coders and ex coders who enjoy playing there work from "back in the day" as much as we do. So while we aren't doing any harm and providing a nice nostalgia trip, they tend to leave us alone. Which is how it should be.
We don't allow requests for cheats or emptiers on the site, which has been a pretty hard and fast site rule for years, emulating the modern games only allows people to find cheats and emptiers so should be excluded with the same vigor.
Now all we have to do is get everyone to agree on what "modern" means.
